does anyone know the legal rights for a person to remain in their own home once the cost of providing care reaches the same amount as paying for residential care?
I have been told by social services that they wil pay for home care cost to the value of residential care, once the cost goes over that amount the person will either have to pay the difference themselves if possible if not, if not the will either have to go into sheltered accomodation were it will cost less for monitoring care, or go into a residental setting. i was under the impresion that a person had the right to remain in their own home as long as they wish to do so, The opt out for s/s is to say that if a person needed 24-7 care in their own home to such a high cost ,then its not safe under health and saftey for them to remain at home. thus cost does take president but under the heading that it is unsafe (nice cop out excuse i say) the comment made to me recently from a social worker was; if we pay for one person to remain at home to such a high cost then ikt would open the flood gates for others and there is not enough money. |

Information Commissioner Richard Thomas warned the DVLA back in 2002 that the sale of personal details could be illegal but has done nothing to stop it. Over the six-week period, one firm alone, Creative Car Park Management (CCPM), obtained the addresses of 2,746 drivers from DVLA. It has contracts with the Co-op, Kwik Save and Aldi, and demands fines of up to £170. A year ago this newspaper discovered that among those given driver details was a firm run by Britain's most notorious clamping thugs, Gordon Miller and Darren Havell, who were serving seven years' jail between them for extorting money from motorists. A DVLA spokesman said: "The DVLA is extremely serious about protecting driver and vehicle data and has introduced procedures to ensure the system for releasing information examines requests robustly." - standard blurb.........but it's not, is it? These 'parking fine' scams could not exist if the Government (DVLA) did not 'sell' on, to the general public, information that should be protected by the Data Protection Act - the registered keeper details of vehicles. This type of information should ONLY be accessable by Government officials - ie the Police, Councils ect., NOT private individuals = private companies! Write to your local MP and insist that the DVLA be taken to book for it irrisponsible action.

Recently we have been targeted by Civil Enforcement Ltd
fortunately we saw your article on Gary Wayne and sussed it out also by contacting our Borough Council who run the car park where the photos were taken, we are concerned about the rest of the people targeted at the same time in this way, the car park in question is in Altrincham Cheshire.

These guys are now operating in Watford, Herts in shopping retail parks - I just became a victim too.
This scam could not exist if the Government did not 'sell' on information that should be protected by the Data Protection Act - the registered keeper of vehicles. This information should ONLY be accessable by Government officials - ie the Police, Councils ect., NOT private individuals = private companies! It is obviouse that this company (Civil Enforcement Ltd) is a rouge outfit - having liquidated it'self several times and in how it demonstrates an unethical business practice of extracting monies from 'innocent' people. How is it then that the Govenment can hold it's head up high and say it's OK to 'sell' on our confidential information to the likes of these people?! - What will happen if the National ID card goes ahead - who the hell will be buying that information and how will they be using that? Forget Civil Enforcement Ltd (they haven't a leg to stand on in law to collect any monies - it's all just threats - call the police if threatened/harrassed) - It's the Government we should all be targeting and lobby for them to reverse their decission to allow private individuals access to confidential information which should be protected under the Data Protection Act. End of story...........................

Xmas eve and time for cheer and good will - but today we have had more folks seeking answers as to why they are receiving parking fines from Gatwick MacDonalds. Our advise is don't use it at all , keep looking at UK Rights for the results of court case when Civil Enforcemnet Ltd attempt to take Help-me-Park.com Ltd to court over this matter. We are confident that we will win and when we do we WILL tell you how to do the same.

I got a £150 parking ticket from McDonalds at Gatwick Airport - I am NEVER going to buy another McDonalds for the rest of my life - this is just greed, robbery and an abuse of their own customers - just antoher example of a large greedy corporate monster taking it out on the little guy. Your site is great and I am sure that it will be used by many people - I for one have had enough of the way people in the UK are treated as crimiinals even before they have done anything - its got to stop so well done for taking the initiative.

I too have been scammed by the parking at BP north. Two weeks after I was there I recieved a ticket timing me as being there 41 minutes. I used the shop and spent the rest of the time in the car. Needless to say I was outraged and wrote to tell them so. They claim there are notices at the entrance, there were not and that the signs are prominent, they are'nt, and enclosed photos to prove it. They cannot be contacted by phone unless you want to pay and they do not respond to letters. They just keep sending automated agressive statements each time increasing the fine. I have now recieved a letter from a debt collection agency and again I have written back saying why I refuse to pay. The frustration is that they do not respond and they have no procedure for anyone who challenges them, but I suppose that is all part of their way of ripping you off. Anyone else out there who has recieved a ticket from CEL - DO NOT PAY. If they want to take me to court, as they threaten, I would be delighted. I have sent them my costs relating to fighting the ticket too.

Like Doctor 'A' I am also a victim of CEL and I have received similar replies from them. As far as I am aware, there is no legal requirement for me to give them any information - whether I was driving at the time or whether someone else was driving. They obtained my details from the DVLA but have not entered into thier voluntary code of practice i.e by leaving a note attached to my vehicle. I intend to fight this and will attend county court if I have to. If I find CEL have acted illegally, I will take legal action. I have received the final reminder from them prior to them taking court action and I am waiting to see what happens next. My advice to anyone - don't pay. If nobody paid, are they going to take everyone to court? I have not contacted McDonalds because I can't be bothered to waste any more time - I will never use McDonalds again neither will my family. I tell as many people as I can about this and they are all amazed at what is happening. McDonalds will be the loosers in the end and I will be all the more healthy as a result of not eating their rubbish. Good luck to anyone else caught up in the activities of CEL and lets see what happens.

If CEL claim breach of contract rather than trespass their claim will still be unenforceable. In Dunop Pneumatic Tyre Co v New Garage and Motor 1915 the judge laid down rules that still apply today.
The sum is a penalty if it is greater than the greatest loss which could be suffered from the breach. If it agreed that a larger sum shall be payable in default of paying a smaller sum, this is a penalty. Penalties are unenforceable in contract law. |

So here we go again! Another way to take cash out of the motorist! Another way to tax the overtaxed!
We wonder how much 2-Jags and the rest of the crew are going to have to pay for all the swanning around they do at our expense! One of the UKRights team was on a plane flying back to the UK from Spain recently and struck up a conversation with a pasenger - the passenger had lived in Spain a long time and explained that there are very few speed cameras there, virtually no CCTV and that if the Spanish government tried any of the stunts that the british government keep putting on then the Spaniards would be on the streets overturning cars and in the blink of an eye. he continued - the only reason that the UK Government get away with any of this is people the British People LET THEM! If there was another Cromwellian figure who emerged and said to the nation - "Right then - thats enough of that - lets go do something about it" - the british government would run a mile - after all they can't argue or even begin to control 60 Million people who are on the streets because they have been taxed, taxed and then taxed again on their taxes. He finished off by syaing that he went to Spain when he retired but had he been a younger man he woudl have stayed in the UK and told the government where to shove it. We couldn't agree more! |

We have been inundated with complaints about parking fines imposed by private companies using ANPR (Automatic Number Plate Recognition) and other methods.
McDonalds and BP at Gatwick Airport have come under a huge amount of fire for this sinister practice. Even at the most basic level this is entrapment This stinks to the core and the the Government has dramatically failed in two key areas to protect the general public from the sort of bully boy tactics these companies employ. 1. The DVLA Scrapped their code of conduct for people accessing the DVLA Records as these companies do. WHY??? There needs to be a clear set of criteria for the issuing of such data and only governmental parties should have access to this NOT private commercial concerns. What’s the point of having Data Protection Laws if the DVLA are simply going to ignore them. We feel that the DVLA (nor any other governmental body paid for out of tax payers money) has any business assisting a private company to issue a fine. 2. There is no governing law on this matter and that needs to be drawn up without delay. The law should work in the interest of the individual to ensure that companies who carry out the issuance and collection of such fines are: a) Registered b) licensed c) Accountable There should be strict tariffs for the fines which should limit the amount of money a company can impose. A recipient of such a fine should always have recourse to the courts. Unless the government steps in and takes ownership of the problem its simply going to cost the government millions of pounds in court cases as the UK electorate become acutely aware of the laws that DO protect their civil and human rights in these cases. Mr. Blair - it's time to act to stop these outrageous practices - otherwise it will get out of control and the courts will be buried under a mountain of paperwork. UKRights.org (and the Great British Public) will make sure of that! |

Another fine example of how Civil Enforcement Ltd and BP operate a "one rule for us and another rule for everyone else" policy. UKRightst think that its despicable that BP shows favourtism to one company by allowing them to break the rules. Wew ill kepp watching with interest to see if our friend here gets his money back.

I was parked at the BP garrage at Gatwick North on the 23/08/2006 from 12-01 to 12-34 durring which time I purchased a coffee, a sandwich and a news paper, I received a parking fine through the post three weeks later for £150, I have been parking at this garage for over ten years while I wait for my clients (I run a Minbus airport service) durring this time I have never been asked to move on, in fact the garage have encouraged parking on there forecourt by supplying one operator with tables & chairs round the back of the garage for there drivers (this company is called TPS and operate a valet parking service for clients from the BP garage until recently) they are based in Crawley. So how can they encourage one company to park up to six vehicles at a time 24 hours a day on there forecourt and then jump on the rest of us for going ten minutes over our time (and twenty minutes is imposible to drink a hot drink and eat a sandwich)and charge us £150. I have paid up but am now trying to recover my money. My next move is to take out court papers against BP UK for what is a totaly unreasonable action.

WELCOME TO THE PROTEST!
MY PCN WAS ISSUED BY CEL FOR SYAYING IN THE BP GARAGE 31 MINS. ON 26TH AUGUST. OVER THE LAST FOUR MONTHS I HAVE BEEN PARTICIPATING IN THE BOYCOTT OF ALL BP GARAGES AND I LIKE MANY OTHERS ARE AWAITING OUR DAY IN COURT! I HAVE CONTRIBUTED CONSIDERABLY TO THE PEPIPOO FORUM ON THIS SUBJECT AND HAVE EXHAUSTED ALL THE PROCEDURES AS FOLLOWS: 1. APPEALED TO CEL -REFUSED! 2. HAD AN ARTICLE PRINTED IN THE SUSSEX ARGUS NEWSPAPER (24/09) PUBLCISING THIS SCANDAL. 3. CONTACTED BP CUSTOMER CARE ON NUMEROUS OCCASIONS (FREEPHONE 0800 402402 OPTION 3 MANAGER IS KARIN) -WILL NOT CANCEL MINE BUT HAS CACELLED MANY OTHERS! 4. WRITTEN LEGAL LETTER TO CEL CHALLENGING THE LEGALITY OF THE PCN. -EVENTUALLY REPLIED THAT NO FUTHER CORRESPONDENCE WOULD BE ENTERED INTO SO PAY UP OR ELSE! 5. ASKED FOR PHOTO EVIDENCE FROM CEL AS THIS WILL BE USEFUL IN COURT -ARRIVED WEEKS LATER AFTER INVOLVING KARIN AT BP! 6. PROTESTED TO MY MP ABOUT PERSONAL INFORMATION OBTAINED BY CEL FROM THE DVLA -SHE WAS EVENTUALLY INFORMED THAT THEY WILL SEND INFORMATION TO `RESPECTABLE` COMPANIES FOR A CHARGE OF 2.50! 7. MY MP PROTESTED TO THE CHAIRMAN OF BP -RECEIVED A STANDARD REPLY FROM ONE OF HIS MINIONS! 8. RECEIVED A `FINAL REMINDER` FROM CEL -THREATENING ME WITH LEGAL ACTION ON 16/11. 9. SENT YET ANOTHER EMAIL TO KARIN AT BP ON 23/12 ASKING TO CANCEL PCN AGAIN -NO RESPONSE AS USUAL! MY ADVICE TO EVERYONE CAUGHT UP IN THIS FIASCO IS DO NOT PAY! BAILIFFS CAN ONLY BE SENT AFTER COURT PROCEEDINGS. BOYCOTT ALL BP GARAGES -IF THE GATWICK BUSINESSES WERE FRANCHISED, THEY WOULD BE STRUGGLING BY NOW! THERE ARE ONLY FOUR EMPLOYEES AT THE BP CUSTOMER (DON`T?) CARE LINE SO CONTACT THEM ON THE FREE NUMBER ABOVE AND OBTAIN A CASE NUMBER. (REMEMBER KARIN HAS CANCELLED SOME OF THESE PCN`s) THERE ARE 30 PAGES OF ADVICE AND COMMENTS ON THE PEPIPOO FORUM -REFER TO THEM FOR ADVICE!
